Medical Funding: The Good, The Bad and The Ugly

What comes to your mind when you hear the words… “Funding Company”?

I’ve had attorneys and imaging center owners both use the term “necessary evil” on more than a few occasions. I’ve had other attorneys and imaging centers also call them “vital”.

So, why is there such a divide and a black-and-white view of medical funding companies in our industry?

You can come up with many reasons, but at the end of the day it all boils down to contracts and settlements.

Contracts have been under the microscope for the past few years. Cases against medical funding companies, pre-settlement advance companies, and physicians have been on the rise throughout the United States. And the main reason behind this increase is bad contracts.

There’s a perfect mix when it comes to the formation of a medical contract in personal injury. There has to be room for the case to breathe. There also has to be room for everyone involved to be compensated fairly if the case is valid. What our industry has seen over the past few years is an influx of speculators. A lot of the medical funding companies that popped up do not have a background in finance or medicine. They are strictly groups using our industry like the stock market. Trying to make the quick buck until the market is drained due to their greed. They are only willing to stay in the game until laws change. They are also the ones behind bad contracts that lead to greed that leads to laws being changed.

And this moves us to the second part of this discussion.

Settlements are the final tipping point when it comes to the worth of a funding company. Bad contracts and greed lead to difficult settlements. Difficult settlements lead to unhappy adjusters, pissed off injured clients and frustrated legal professionals. Settlements that are all over the map, because of these bad contracts, also put everyone in the industry under a microscope.

So what do we do to fix this?

First, know your funding source!

Who are the owners? Are they a private equity firm? Are they knowledgable professional who understands their discipline? Are they going above and beyond to care for your client?

Second, know a bad contract!

Is your starting point of negotiations always near 100%? Are they always pushing treatment to a specific location or medical provider? Do they always seem to suggest the same treatment plan? (NOTE: This also goes for In-House Funding and Health Insurance… these can be terrible contracts too.)

There are definitely a lot of other factors that go into testing your medical funding source. But, when you peel back the onion, this is the baseline. This is where you can start your testing to see just how they serve your clients.

Bad Drivers Continue to Do Their Thing

Bad Drivers Are Undefeated

A lot of us in Personal Injury were interested to see how the Shelter-In-Place orders around Georgia (and Nation) would affect the volume of accidents. Some thought the worst. Others simply were optimistic and praying for the best for their business.

Well, Georgia seems to keeping it as essential business as the Atlanta Journal Constitution reported accidents on it’s major interstates remained the same for the month of March.

According to the report, traffic volume on Georgia 400 and Interstate 285 was down 30-35% for the month of March. Despite the decrease in volume, there were still 330 traffic accidents reported which is about an average month.

What is the culprit for accidents staying the same despite volume being lower?

Super speeders!

The Sandy Spring Police Department said they stopped 52 drivers in March with 21 of them driving in excess of 100 MPH. One driver was even caught going 129 MPH.

In other words, the road may look clear and safe, but bad drivers will always be bad drivers.

Which is good news for all of us in the personal injury field.

Ordering the Right Diagnostic Test for Brain, Nerve and Spine Injuries

  • DTI is a magnetic resonance imaging technique that enables the measurement of the restricted diffusion of water in tissue in order to produce neural tract images instead of using this data solely for the purpose of assigning contrast or colors to pixels in a cross-sectional image. The advantage in layman’s terms is DTIs makes it possible to estimate the location, orientation, and anisotropy of the brain’s white matter tracts. By doing this, it allows a true view of damage to these areas. It was first offered in 1991 and has gained a lot of popularity among medical professions in the past 10 years. The applications and clinical use in personal injury and traumatic brain injury cases have increased as well in the past five years. NeuroQuant(R)

  • NeuroQuant is software that analyzes a brain MRI to improve the early detection and treatment of dementia, Alzheimer’s disease, traumatic brain injury, multiple sclerosis, and epilepsy. NeuroQuant precisely measures the brain atrophy (shrinkage) by measuring the hippocampus and other brain structures that usually shrink when a patient has certain conditions affecting the brain. NeuroQuant can help your doctor diagnose and follow the progression of certain diseases. NeuroQuant compares an MRI of a patient’s brain to a database, approved by the U.S. Food and Drug Administration, of people of the same age, sex and skull size who have healthy brains. This has been a game-changer when it comes to traumatic brain injury cases as there are more documented comparables from athletes and others who have declined in their mental capacity over time due to initial concussions. The database will only continue to improve helping make this a viable option in personal injury diagnosis and treatment.

Vertebral Motion Analysis (VMA)

  • VMA is a full-motion X-Ray that allows medical professionals to pinpoint the areas of damage and pain in patients. The VMA, unlike a common x-ray, takes hundreds of x-ray type pictures of your spine while you move to create a video. VMA provides more accurate motion measurements to help diagnose your unique condition and gives you an analysis of the spine in real-time. Studies have proven the VMA is 30% more reliable than traditional X-Rays.

Electroencephalogram (EEG)

  • An electroencephalogram (EEG) is a noninvasive test that records electrical patterns in your brain. The test is used to help diagnose conditions such as seizures, epilepsy, head injuries, dizziness, headaches, brain tumors, and sleeping problems. It can also be used to confirm brain death. A cost-effective way to help diagnose and treat in personal injury.

Electromyography (EMG)

  • Electromyography (EMG) is a diagnostic procedure that evaluates the health condition of muscles and the nerve cells that control them. These nerve cells are known as motor neurons. They transmit electrical signals that cause muscles to contract and relax. An EMG translates these signals into graphs or numbers, helping doctors to make a diagnosis. EMG results can help the doctor diagnose muscle disorders, nerve disorders, and disorders affecting the connection between nerves and muscles. A very vital test for some of our personal injury patients for sure.
